Terms of service
Last updated: [date]
These terms are between you and [Company name], a company registered in England and Wales (company number [number]), with its registered office at [address] ("we", "us"). They apply when you sign up for and use ShootDesk ("the service") to run your photography or videography business.
1. Your account
- You must be 18 or over and using the service for your business.
- Keep your login details safe. You're responsible for what happens under your account.
- Give us accurate details, and confirm your email address before sending messages to your clients.
2. Plans and payment
- Plans, prices and what each includes are shown on our pricing page. [Describe billing, renewal and refunds once paid plans are charged.]
- We may change prices with at least 30 days' notice. You can change or cancel your plan at any time.
3. Your clients' data
You decide what information about your clients goes into the service and what it's used for, so for that information you are the data controller and we are your data processor. We only process it to provide the service to you, as set out in our privacy policy, and these terms are our data processing agreement with you under UK GDPR. You're responsible for having a lawful basis to hold your clients' details and for answering their requests, which the service helps you with (exporting or erasing a client's data).
4. Acceptable use
- Only send messages to people you have a business relationship with. No spam.
- Don't upload anything unlawful, or try to access other accounts or disrupt the service.
- Optional AI features send the text or images you choose to our AI provider to draft messages or fill in forms. Check anything they produce before using it.
5. Availability and changes
We aim to keep the service running smoothly but can't promise it will always be available or error-free. We may change or improve features, and will tell you in advance about changes that significantly affect you.
6. Ending your account
You can download all of your data and delete your account at any time from Settings โ Your data. We may suspend or close accounts that break these terms. You're responsible for keeping your own business records, such as the invoices UK tax rules expect you to keep for six years.
7. Liability
Nothing in these terms limits liability that can't be limited by law. Otherwise, we're not liable for indirect or consequential losses, or for lost profits or business, and our total liability in any 12 months is limited to the fees you paid us in that period. [Review this clause with your solicitor.]
8. Law
These terms are governed by the law of England and Wales, and its courts have jurisdiction.
